  • SPECIAL PUBLIC NOTICE - COMMENT PERIOD EXTENSION FOR THE CLEAN WATER ACT PROPOSED RULE FOR DEFINITION OF WATERS OF THE U.S.

    On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act. This notice is to announce that the comment period has been extended through November 14, 2014. The comment period has been extended in response to stakeholder requests and to allow comments on new supporting materials. The agencies expect to receive additional relevant materials from the Science Advisory Board prior to October 20, 2014, which will be placed on the docket as soon as they are available. We encourage interested parties to periodically check the docket for updates on these materials. The comment period which was originally scheduled to end on July 21, 2014, had been previously extended to October 20, 2014. Comments now must be received on or before November 14, 2014.

  • SPECIAL PUBLIC NOTICE - [Final] Regional General Permit No. 14 for Fort Carson and Piñon Canyon Maneuver Site Erosion Control and Other Minor Activities

    The U.S. Army Corps of Engineers, Albuquerque District, hereby issues Regional General Permit (RGP) No. 14 for erosion control and other minor activities in waters of the U.S. on the Fort Carson Army Garrison (Fort Carson) and Piñon Canyon Maneuver Site (PCMS). The purpose of this public notice is to inform interested parties of the availability of the RGP.

  • SPECIAL PUBLIC NOTICE - UPDATES TO THE REGIONAL CONDITIONS FOR NATIONWIDE PERMITS WITHIN THE STATE OF COLORADO

    On March 19, 2012, the Albuquerque District Army Corps of Engineers published a public notice advertising the issuance of the 2012 nationwide permits and the Colorado Regional Conditions. The purpose of this public notice is to inform interested parties of minor revisions to the Colorado Regional Conditions, which include an update to the list of Gold Medal Waters and added language under Regional Condition No. 7 encouraging pre-application consultation with Colorado Parks and Wildlife.

  • SPA-2009-427-ELP; The Paseo Del Norte Drainage Improvements Project

    The U.S. Army Corps of Engineers, Albuquerque District, (Corps) and the Texas Commission on Environmental Quality are evaluating a permit application to construct the Paseo Del Norte Drainage Improvements project, which would result in proposed impacts to approximately 2,722-linear feet (1.34-acres) of ephemeral washes, which are waters of the United States in Flow Path 38, El Paso, Texas. This notice is to inform interested parties of the proposed activity and to solicit comments. A previous Public Notice was issued for this project on January 14, 2011. That Public Notice described a project with proposed impacts to approximately 4,615-linear feet (2.23-acres) of ephemeral washes, which are waters of the United States. In accordance with § 325.2 (a)(2), Processing of applications, the District is issuing a revised Public Notice to inform the public that the Applicant, after evaluating an additional alternative, has significantly reduced proposed impacts to waters of the United Sates. This has resulted in a reduced permit area and a change in the Applicant structure. Additionally, a detailed mitigation plan has been developed by the Applicant.

    The U.S. Army Corps of Engineers, Albuquerque District, is evaluating a permit application from Kinder Morgan to conduct pipeline maintenance. The project will result in permanent impacts to approximately 0.01 acre of waters of the United States in an unnamed tributary to Jaquez Arroyo. The purpose of this public notice is to inform interested parties of the project and to solicit comments.
