Navigable Waters of the U.S.

Section 10 of the Rivers and Harbors Act of 1899 requires approval from the U.S. Army Corps of Engineers (Corps) prior to the accomplishment of any work in or over navigable waters of the United States, or which affects the course, location, condition or capacity of such waters. Typical activities requiring Section 10 permits are:

  • Construction of piers, docks, wharves, bulkheads, dolphins, marinas, ramps, floats, intake/outfall structures, and cable or pipeline crossings.
  • Dredging and excavation

The following is a list of waters within the Albuquerque District's area of responsibility which have been determined to be jurisdictional under the Rivers and Habors Act. These are commonly referred to as Section 10 waters.

  • The Rio Grande from the American Dam in El Paso, Texas, downstream to the limit of the Albuquerque District near the Amistad Dam in Texas.
  • Portions of the Amistad Reservoir on the Rio Grande in Texas, at elevations of 1117 feet and below.
  • Navajo Reservoir in New Mexico and Colorado.
  • The Colorado River from the 5th Street Bridge in Grand Junction, Colorado, downstream to the Colorado-Utah state line.
