SPA-2018-00329-SCO – Draft RGP 15 for City of Colorado Springs Permanent Extended Detention Basin (EDB) Maintenance Activities

SUMMARY OF PROPOSED ACTION: The U.S. Army Corps of Engineers, Albuquerque District, (Corps) is proposing to issue Regional General Permit (RGP) 15 for maintenance of existing stormwater management facilities under the City of Colorado Springs Permanent Extended Detention Basin (EDB) Maintenance Program. This notice is to inform interested parties of the proposed RGP and to solicit comments.

PURPOSE AND NEED: The purpose of this proposed RGP is to provide a streamlined permitting mechanism for maintenance activities that cause only minimal individual and cumulative environmental impacts in existing stormwater management facilities that have been adopted into the City of Colorado Springs EDB Maintenance Program.

AUTHORITY: Section 404 of the Clean Water Act for the discharge of dredged or fill material in all waters of the United States.

AREA OF COVERAGE: The RGP would be applicable to all waters of the U.S. located within and associated with existing stormwater management facilities within the geographical boundaries of the city limits of Colorado Springs in the State of Colorado.

SCOPE OF ACTIVITIES: Activities proposed to be authorized by this RGP are limited to those activities that are required in order to maintain existing EDBs at the constructed baselines, as defined by the EDB Maintenance Program, including, but not limited to, cleaning, maintenance, and repair of inflow points, fore-bays, trickle channels, micro-pools, outlet structures, and embankments, removal of accumulated sediment.

LENGTH OF AUTHORIZATION: The regional general permit, if issued, will expire five years from the date of issuance.

OTHER GOVERNMENTAL AUTHORIZATIONS: Water quality certification or a waiver, as required under Section 401 of the Clean Water Act, is required for this regional general permit. The State of Colorado Water Quality Control Division is evaluating the proposed RGP and the Corps anticipates that Colorado 401 Water Quality certification will be issued for the permit.

COMMENT PERIOD: All comments pertaining to this Public Notice must reach this office on or before December 9, 2018. Extensions of the comment period may be granted for valid reasons provided a written request is received by the limiting date. If no comments are received by that date, it will be considered that there are no objections. Anyone may request, in writing, that a public hearing be held to consider this application. Requests shall specifically state, with particularity, the reason(s) for holding a public hearing. If the Corps determines that the information received in response to this notice is inadequate for thorough evaluation, a public hearing may be warranted. If a public hearing is warranted, interested parties will be notified of the time, date, and location.
