Colorado Regional General Permit 96 Reissuance

The U.S. Army Corps of Engineers, Albuquerque and Omaha Districts (Corps), are proposing to renew the issuance of Colorado Regional General Permit (RGP) 96 for natural disaster mitigation and flood-related activities in the State of Colorado. The purpose of this public notice is to inform interested parties of the proposed re-issuance of RGP 96 and to solicit comments. The existing RPG 96 was issued on October 1, 2021, and expires on September 30, 2026.

The purpose of this public notice is to inform interested parties of the proposed re-issuance of RGP 5 and to solicit comments. The existing RPG 5 was issued on July 30, 2021, and expires on July 30, 2026.

On January 8, 2026, the U.S. Army Corps of Engineers (Corps) published a final action in the Federal Register (91 FR 768) announcing the reissuance of 56 existing nationwide permits (NWPs) and one new NWP, as well as the reissuance of NWP general conditions and definitions with some modifications. These 57 NWPs will go into effect on March 15, 2026, and will expire on March 15, 2031. One NWP was not reissued. This public notice gives information on the regional conditions that apply to the 57 NWPs in the Navajo Nation.

Effective May 1, 2026, the Albuquerque District expects all new requests for Regulatory Program products to be submitted through USACE’s Regulatory Request System at https://rrs.usace.army.mil. New requests submitted by email, including through the district’s general mailbox (“SPA-RD-CO@usace.army.mil” or “SPA-RD-NM@usace.army.mil “), or other means may not get processed promptly.

Fountain Creek Watershed District In-Lieu Fee Program

The U.S. Army Corps of Engineers, Albuquerque District is evaluating a prospectus for the establishment of the Fountain Creek Watershed District In-Lieu Fee Program, which would result in the re-establishment and rehabilitation of wetlands and restoration of streams within the Upper Arkansas watershed within El Paso and Pueblo Counties. If authorized, this ILF Program would enter into financial transactions with individuals or entities receiving authorizations under Section 404 of the Clean Water Act, as amended, when appropriate, to provide compensatory mitigation credit as part of Clean Water Act Section 404 permit or enforcement actions within the proposed service area. This ILF Program would also provide compensatory mitigation credit as part of the State of Colorado’s Water Quality Control Regulation No. 87, and conservation credit pursuant to the Endangered Species Act. This notice is to inform interested parties of the proposed activity and to solicit comments. The final prospectus for the proposed FCWD ILF Program titled, Fountain Creek Watershed District In-Lieu Fee Program Prospectus, dated December 17, 2024, is included as an attachment to this public notice.

Public Notice Announcing the Reissuance of the Nationwide Permits (NWPs)

On January 8, 2026, the U.S. Army Corps of Engineers (Corps) published a final action in the Federal Register (91 FR 768) announcing the reissuance of 56 existing nationwide permits (NWPs) and one new NWP, as well as the reissuance of NWP general conditions and definitions with some modifications. These 57 NWPs will go into effect on March 15, 2026, and will expire on March 15, 2031. The Corps has also issued final decision documents for the new and reissued NWPs. These final decision documents are available at www.regulations.gov at docket number COE-2025-0002. Furthermore, the national NWP decision documents will be supplemented by Division Engineers to address decisions concerning the addition of regional conditions to the NWPs.

Pickup Pond Wetland Mitigation Project (SPK-2003-75278)

The USACE-Albuquerque District is evaluating a proposal to develop the Pickup Pond Wetland Mitigation Project associated with the Mesa County Umbrella Mitigation Bank. This development plan is being evaluated under 33 Code of Federal Regulations (CFR) Part 332.8. The project site is located directly north of the Colorado River, approximately one mile upstream of the 29 Road Bridge over the Colorado River, at latitude 39.053112°, longitude -108.500159°, Mesa County, Colorado.

EP Water - Heath de Leon Water Transmission Main (408-SPA-2025-006)

In compliance with U.S.C. Title 33, Chapter 9, Subchapter 1, Section 408, EPWater (requester and non-federal sponsor of the federally authorized project) has requested permission from the U.S. Army Corps of Engineers to alter the Buena Vista Diversion Channel federal project; a concrete-lined diversion channel which is part of a federal flood risk management project authorized by the Water Resources Development Act of 1986. The purpose of the Heath de Leon Water Transmission Main project is to install a pipeline to transport potable water from the Heath De Leon Booster Station to the existing Festival Reservoir and further into the Crown Point pressure zone. This project is a continuation of the Crestmont to Festival Reservoir 30-inch Water Transmission Line project that was completed in December 2022.

Rio Grande Levee Realignment – Geotechnical Testing (408-SPA-2024-003)

Santa Fe Indian School - Pueblo Education Network (408-SPA-2025-007)

The Middle Rio Grande Conservancy District is the non-federal sponsor for the Middle Rio Grande Flood Protection Bernalillo to Belin New Mexico project. The Santa Fe Indian School – Pueblo Education Network project is a 324-mile-long cable installation project, a portion of which would be crossing under the Rio Grande within the Pueblo of Isleta, Bernillo and Valencia Counties, at approximately Latitude 34.906215°, Longitude -106.685243°.
