      The purpose of this notice is to advise the general public of the implementation of the Functional Assessment of Colorado Wetlands (FACWet) Method. Effective immediately and until further notice, the FACWet method will be required for use when evaluating and assessing wetlands in conjunction with applications for certain Section 404 Permits from the Corps’ Southern Colorado Regulatory Office.

The Regulatory Program of the U.S. Army Corps of Engineers (USACE) is seeking public input on its plan to retrospectively review its Regulations implementing the USACE Regulatory Program at 33 CFR 320-332 and 334.  Executive Order 13563, “Improving Regulation and Regulatory Review,” issued on January 18, 2011, directs federal agencies to review existing significant regulations and identify those that can be made more effective or less burdensome in achieving regulatory objectives.

On May 2, 2011, the Environmental Protection Agency (EPA) and U.S. Army Corps of Engineers (USACE) jointly published in the Federal Register their proposal to issue clarifying guidance for determining which waters and wetlands are protected under the Clean Water Act (CWA) programs. The agencies are soliciting comments on the proposed draft guidance from interested parties, and the comment period will be 60 days.

On May 13, 2011, the U.S. Army Corps of Engineers published in the Federal Register, a proposal to authorize Natural Resources Conservation Service (NRCS) approved categorical exclusions for inclusion under Nationwide Permit 23 (NWP 23). NWP 23 is used to authorize certain actions by other Federal agencies that are categorically excluded under the National Environmental Policy Act (NEPA), in accordance with 40 CFR Parts 1500 to 1508, because the action is included within a category of actions that have no more than minimal individual and cumulative adverse environmental effects.

  The U.S. Army Corps of Engineers (Corps) has suspended the use of Nationwide Permit 21 (NWP 21) in the Appalachian region of Kentucky, Ohio, Pennsylvania, Tennessee, Virginia and West Virginia, and announced this decision in the June 18, 2010, edition of the Federal Register.

The U.S. Army Corps of Engineers, Albuquerque District, (Corps) is evaluating a permit application to construct the Beckner Road Equities’, Las Soleras Development, including the construction of culverts and bank stabilization, in Santa Fe, Santa Fe County, New Mexico. The proposed project would result in impacts to approximately 0.62 acres or 17,010 total linear feet of waters of the United States in or adjacent to Arroyo de los Chamisos and its ephemeral tributary within the proposed project area. This notice is to inform interested parties of the proposed activity and to solicit comments.

The United States Army Corps of Engineers, Albuquerque District is requesting public comment on the following project before the above comment due date. The City of Rio Rancho proposes to install approximately 2,582 linear meters [m] (8,470 linear feet [ft]) of 30-inch DR-21 high-density polyethylene (HDPE) pipe below the bed surface of the Los Montoyas Arroyo from the north side of Northern Boulevard to the water quality structure upstream of the SportsPlex Dam east of Broadmoor Drive, and then another 137 m (450 ft) of 36-inch HDPE sanitary sewer DR-21 HDPE pipe will be installed to connect to an existing 36-inch HDPE pipe at the project terminus. This project would result in approximately 11 acres of impacts to waters of the United States.  This notice is to inform interested parties of the proposed activity and to solicit comments.

On February 24, 2011, the U.S. Army Corps of Engineers, Galveston District, published a Public Notice of the initial draft of the Texas regional conditions, as they pertain to the proposal to reissue 48 of the U.S. Army Corps of Engineers existing nationwide permits (NWPs) and issue two new NWPs.  This Public Notice is to inform you of the revisions made to the proposed Texas regional conditions.  Comments received during the initial Public Notice were reviewed and incorporated into these revised Texas regional conditions.
