Submar Job #12562 – Pipeline Maintenance (Action No. SPA-2014-00039) - 7/14/2014: The U.S. Army Corps of Engineers, Albuquerque District, is evaluating a permit application from Kinder Morgan to conduct pipeline maintenance. The project will result in permanent impacts to approximately 0.17 acre of waters of the United States in an unnamed tributary to Blanco Wash. The purpose of this public notice is to inform interested parties of the project and to solicit comments.

McDonald Ditch Project (Action No. SPA-2013-00381) - 7/10/2014: The U.S. Army Corps of Engineers, Albuquerque District (Corps), is evaluating a permit application from the McDonald Ditch Company to construct a new diversion dam in the Rio Grande River approximately 930 feet upstream from an existing structure. The project will result in 0.015 acre of permanent impacts and 0.023 acre of temporary impacts to scrub/shrub wetlands adjacent to the Rio Grande River. Impacts to the Rio Grande river will consist of 0.127 acre of permanent impacts and 0.24 acre of temporary impacts. In addition, approximately 380 linear feet of riprap will be placed along the bank. The existing diversion structure will be dismantled and replaced with a rock grade control structure. The purpose of this public notice is to inform interested parties of the project and to solicit comments.

SPECIAL PUBLIC NOTICE - COMMENT PERIOD EXTENSION FOR THE CLEAN WATER ACT PROPOSED RULE FOR DEFINITION OF WATERS OF THE U.S. - 6/16/2014: On 21 April 2014, the USEPA and the Corps of Engineers (Corps) published for public comment a proposed rule defining the scope of waters protected under the Clean Water Act (CWA), in light of the U.S. Supreme Court cases in U.S. v. Riverside Bayview, Solid Waste Agency of Northern Cook County v. U.S. Army Corps of Engineers (SWANCC), and Rapanos v. United States (Rapanos). The proposed rule was developed to enhance protection for the nation’s public health and aquatic resources, and increase CWA program predictability and consistency by increasing clarity as to the scope of “waters of the United States” protected under the Act. The comment period was originally scheduled to end on July 21, 2014. This notice is to announce that the comment period has been extended through October 20, 2014. Comments must be received on or before October 20, 2014.

JOINT PUBLIC NOTICE Number SPA-2013-00174-LCO - 6/3/2014: The U.S. Army Corps of Engineers, Albuquerque District (Corps), the New Mexico Environment Department’s Surface Water Quality Bureau (SWQB), and the Texas Commission on Environmental Quality (TCEQ) requests comments on Regional General Permit (RGP) NM/West TX-14-02 for Sediment and Debris Removal Activities in flood and fire effected drainages within the State of New Mexico and area of West Texas in which the District has jurisdiction. The purpose of this public notice is to inform interested parties of the availability of the draft RGP and to solicit comments.

SPA-2014-00102-ABQ - 5/16/2014: The U.S. Army Corps of Engineers, Albuquerque District, (Corps) is evaluating a permit application to construct the Bureau of Reclamation (BOR) San Felipe Priority Sites: Phase 2 Downstream Project in Sandoval County, New Mexico, which would result in permanent impacts of approximately 2.0 acres and 7.0 acres of temporary impacts to waters of the United States in or adjacent to the Rio Grande. In addition, 0.18 acres of wetlands will be permanently impacted by the proposed project. This notice is to inform interested parties of the proposed activity and to solicit comments.
